Digitalisation and the law
Digitalisation is and will continue to change our lives. If we want to use it as an opportunity, we need to combine three perspectives - business, IT and legal.
That's why the services of Signi and its partners aim to help:
Business people to design digital versions of their processes using Signi.
IT people to make the related technology work in their company's IT environment.
Legal people to navigate the related legal issues.
Electronic legal action
One of the opportunities of digitalisation is electronic legal transactions, which include:
Related legal norms
Electronic identification, signing and archiving are governed in particular by the following laws:
eIDAS - a Regulation of the European Parliament and the Council (EU) transposed into Czech law by Act No. 297/2016 Coll., on trust services for electronic transactions
AML Act - Act No. 253/2008 Coll. - Act on Certain Measures against the Legalization of Proceeds of Crime and Terrorist Financing - also abbreviated as the Anti-Money Laundering Act
Digital Constitution - Act No. 12/2020 Coll., on the Right to Digital Services and on Amendments to Certain Acts
Archive Act - Act No. 499/2004 Coll., on Archives and Records Service
Some areas are then regulated by special laws, e.g.:
HR - the Labour Code regulates the delivery of electronically signed documents, see the archiving period of some documents is set up to 30 years, for more see Electronic signing in HR using Signi,
Real Estate - in addition to the AML Act, the possibility of withdrawing from a contract concluded off the premises is also addressed, a qualified signature is still required for registration in the Real Estate Cadastre,
Construction - e.g. qualified signatures on construction logs are prescribed,
Accounting - in addition to the AML Act, the VAT Act provides for the period of archiving documents
and others.
